CL Educate Limited (Operating the brand "Talevate")

These Terms of Use ("Terms") constitute a legally binding agreement between CL Educate Limited ("Company", "we", "us", "our") and any individual or entity ("User", "you", "your") who accesses or uses the Talevate website, mobile application, or any related services ("Platform").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform.
These Terms incorporate by reference the Privacy Policy, Refund Policy, and all other policies published by the Company.
You must be at least 18 years of age and competent to contract under Indian law.
If accessing on behalf of an entity, you represent that you are duly authorised to bind such entity.
Users must provide accurate, complete, and updated information during registration.
Users are responsible for maintaining confidentiality of login credentials.
Users must promptly notify the Company of any unauthorised access or suspected breach.
The Platform provides educational, assessment, training, and career-related services.
The Company reserves the right to modify, discontinue, update, or alter any part of the Services at any time without notice.
Users may use the Platform only for lawful purposes. Users shall not:
Upload harmful or infringing content
Engage in hacking, reverse-engineering, or scraping
Impersonate another individual or misrepresent identity
Interfere with Platform functioning
Users grant the Company a limited license to store, process, and use uploaded content to deliver Services.
Users represent that content uploaded is lawful and does not violate third-party rights.
All content, course materials, assessments, software, design, and trademarks are owned by or licensed to the Company.
Users are granted a limited, revocable, non-transferable license for personal educational use.
Users shall not copy, distribute, commercialise, or make derivative works of the Platform content.
Fees for Services must be paid in full before access is granted.
The Company is not liable for payment gateway delays or failures.
To make a purchase on the Platform or at CL centers, you must comply with these Terms of Sale and any additional terms applicable to the specific program.
You acknowledge that you are solely responsible for:
Maintaining the confidentiality and security of your account credentials
Restricting access to your account
All purchases, registrations, and actions occurring under your account
Sharing login credentials or account access with others is strictly prohibited.
CL reserves the absolute right to refuse, cancel, or suspend purchases or registrations at its sole discretion, including in cases of suspected fraud, breach of Terms, misrepresentation, or operational requirements.
Accepted payment methods include:
Cash
Cheques (payable at designated centers)
Bank Drafts
Credit Cards (MasterCard, Visa, Discover, American Express – subject to center-wise availability)
Mobile Wallets
Bank Wire or Electronic Transfers
Users must verify payment method availability with respective centers.
No Service shall be provided until full payment is received and confirmed.
Refund for Incorrect Purchase: Programs purchased will not be refunded or changed to another program on the grounds of incorrect selection at the time of purchase.
Duplicate Purchase / Server Error: If the same program is purchased twice due to server error and reported within 7 days: full refund will be issued. If reported after 7 days: a credit note equal to 100% of the purchase value will be issued.
Refund Based on Special Approval: Refund may be considered only if applied within 7 days of purchase.
Admission fees and government taxes are fully non-refundable.
The refund amount, if approved, shall not exceed 25% of the total amount paid, excluding admission fees and taxes.
The Company's refund decision is final and binding.
Refund Processing: Approved refunds will be processed to the original payment method within 45 working days of approval.
Validity: Refund requests must be emailed to support@talevate.in within 7 days. Requests beyond this window will not be considered.
Termination by User: Users may terminate subscriptions anytime via written request; however, no refunds shall be due except as expressly permitted in Clause 11.
Termination by Company for Breach:
Company may issue a 7-day notice to remedy a breach.
If breach is not cured, the Company may terminate access without further notice.
No refunds will be issued for termination due to breach.
Immediate Termination for Misuse: Company may terminate without notice for:
Sharing login credentials
Unauthorised access attempts
Attempting to exploit discounts or promotions
Fraudulent, abusive, or illegal behaviour
Survival: Provisions regarding IP, confidentiality, limitation of liability, indemnity, and payment obligations survive termination.
Personal data collection, storage, usage, and processing are governed strictly by the Company's Privacy Policy.
By using the Platform, you consent to such processing for lawful and service-related purposes.
Users are encouraged to review the Privacy Policy to understand rights and obligations.
The Platform may link to third-party websites or tools.
The Company is not responsible for third-party content, availability, or data practices.
Services are provided on an "as is" and "as available" basis.
The Company does not warrant uninterrupted, error-free, or accurate functioning of the Platform.
The Company disclaims liability for delays, outages, loss of data, or technical issues.
The Company shall not be liable for indirect, incidental, punitive, or consequential damages.
Total liability of the Company shall not exceed fees paid by the User in the preceding six months.
Users agree to indemnify and hold harmless the Company from any claims, liabilities, damages, or expenses arising from misuse, breach of Terms, or violation of laws.
These Terms are governed by Indian law.
Courts located at New Delhi shall have exclusive jurisdiction.
The Company may modify these Terms at any time.
Continued use after modification constitutes acceptance.
